Procedure for delet of 2nd name from share cer. of chs

(Querist) 27 April 2021 This query is : Resolved
Dear Sir,
I would like to know the procedure for Deletion of the 2nd name (due to death) from the Share Certificate of a Co. op. Housing Society. The Share Certificate of a Co.op Housing Soc. has two names as per the agreement. 1st Name Husband, 2nd name Wife. My wife died due to a Heart Attack. so her name is to be deleted from the Share Certificate. There is no addition of any name in the share certificate.
Regards,
Prakash J.
Quick Summary
This discussion outlines the process for removing a deceased spouse's name from a Co-op Housing Society share certificate. The initial request involves submitting an application with a death certificate to the Managing Committee. However, the society is requesting additional documents, including an affidavit on stamp paper, other forms, and a membership application. The advice given suggests checking the society's bylaws, as they likely have a specific procedure for this situation, and potentially lodging a complaint with the Deputy Registrar if the requirements seem excessive or unclear.

You are required to submit an application to MC with death certificate of your wife for deletion of her name from share certificate.

Society is not accepting only application with original Share Cert. and copy of Death Cert.
They want affidavit on stamp paper of Rs.500/- plus other forms and application for membership.

What is the content of the affidavit sought?
Had your wife made any nomination?
Who are the legal heir to your wife?

What are the contents of the affidavit? For an affidavit, only Rs.10/- is sufficient. Make a complaint to the Deputy Registrar of Coop. Housing Societies of your district.
T. Kalaiselvan, Advocate (Expert) 21 May 2021
You may have to go by the bylaws of the society in this regard.
Every society or association would be having a bylaw in this regard as passed by a resolution in a GB meeting, hence the society may be right in demanding you to comply with the procedures as laid down and being followed by all others.
What i the problem that you face to follow the rules which is common to ll and not specially made for you.
