Pocket terrace for our flat

V hv covered pocket terrace in our flat on 1st floor as it was suggested to us by builder at time of purchase of flat.BMC has also regularised it and I m highest property tax payer in 150 flats in our society.Now after 5 yrs committee is saying it's society property and are charging us penalty under section 168 a rs.3000 pm.pls advice wt to do.

We have copy from bmc where it's written our flat is with terrace but committee is not ready to accept.they penalised us under section 164a .when v objected that it cannot be more than rs.5000 annually they changed it to 168 a.kindly advice wt should we do

Whether the sale letter from builder show it with terrace?

Show all related documents to local lawyer and discuss in view of the local rules.

BMC has regularized.

Society is not agreeing and has levied fine that is according to you unreasonable.
Seek local counsels help that is well versed with local rules, laws....

Thnx for yr advice.Have approached bmc as they hv not assessed all day flats in d society.Flower bed covered by many people should be equally penalised.also can society charge us any penalty under section 168 a
