My wife is living sepreatly with her parents past 5 years and we have a baby child 6 years old. My wife is well educated woman and previously working in privet sectors.She File a maintanance case on me and i am working as a sales excutive in a shopping mall and getting Rs. 5500/- only. So how much i have to pay maintainence to her? and may i request to court for Custody of my child because my wife having very rich family background and i belongs to a middle class family so she said u can not fulfill my daughter's wishes so you have no rights to stay with her.

1) what is your wife income ?
2) since your wife is working she wont get maintenance . however you may be called upon to pay Rs 1500 per month towards your child maintenance .
3) you wont get child custody since your daughter is just 5 years old . however court will award you visitation rights

If your wife is earning, the earning may be considered, you have to pay maintenance for daughter in that case also. Maintenance is generally to the tune 30% to 40% or as the court decides.
child custody to you is doubtful, you may get visitation rights.

Unless you wife is earning now you can not avoid maintenance to her.
In any case you are liable for maintenance to the child.
The amount should not be less than Rs.3000/-.
