Dear Experts, Pls Help...!!
My Dad has booked House at Rs. 28 lacs we have registered the house on 20th Oct 2011 and in the agreement the due date to vacant the house was 20th Jan 2011 (3 months). We have Paid him Rs. 10 lacs by Cheque and we asked for Original docs but he was not ready to give it to us so we have not paid him the balance amount. After 3 months owner asked for 1 month extension we even gave that extension which is due tomorrow. Now he asked for 15 days more extension when we said NO now the Owner is not ready to vacate the house and he doesn't want to sell the house to us and he is saying we have cheated him by purchasing house at Rs.28 lacs. Now the house property has increased to Rs. 35 Lacs and now he wants to sell the house at Current price. Can you please guide...

You may send a lawyer notice asking him to vacate the house failing which you may initiate both criminal & civil proceddings.

If the vendor does not vacate within the date specified in the notice you may file a case of tresspass and also file a case for specific performance.
