Pf registeration

(Querist) 01 March 2015 This query is : Resolved 
We have service provider(contractor) for hiring labour to work our Petrol Pump. The service provider has registered his firm i.e XYZ security agency in PF department and he is sole proprietor of this Firm.
We have engage him as service provider by his name Mr. ABC.

Please advise he has registered again for giving PF to hired person of our petrol pump or he can deposit PF by his Firm i.e. XYZ security.

You are not paying salary/remuneration to the boys provided by him. You will be paying his bill. If you register your petrol pump firm with PF and start depositing PF they will be treated as your employees. It is the responsibility of the service provide to deposit the PF of his employees. However, it is always better to obtain proof of depositing last month's PF in the respective PF accounts of the boys who are rendering service at your bunk, so that you will not be held responsible for default in payment of statutory dues in future.

Well answered. For safer side, you may instruct your man power provider to have Work Men's Compensation insurance and obtain the copy of policy for your record every year.

As a principal employer, you are only to ensure that the contractor complies with the provisions of the PF Act/ Rules by depositing the dues in to the PF accounts of the employees.

It is the botheration of the contractor(employer) to deduct and remit the PF amount or not. Your job finishes on settlement of bills to the contractor.

Being principal employer you can ask the manpower contractor to submit evidence for remittance for prior month. This will help you not only compliance of PF Act but also will safeguard you as a principal employer. Any lapse of manpower contractor need to be fulfilled by principal employer (your company).
