Award passed by the controlling Authority for the payment with the interest of 10%as notified by the central Government. But the management maneuvred to subvert the order/ award by getting undertaking from employee not to press the interest, and disbursed the award amount only.When the employee pointed out the non pament of interest, the controlling authority directed for disbursement of.intetest as the award cannot.be modified to withhold interest in vie w of the overriding effect of the Payment of gratuity Actover other legislations. Experts please advise.

Vague and confusing facts.
If the order passed by the Court/ Tribunal is not implimented as directed, move contempt of court.

If interest is not paid as per orders of the controlling authority, send representation for the payment of the same.

If undertaking given in writing for not claiming interest, claim is weak.

The contention of the controlling authority is its order cannot be modifed or nullified merely obtaining a letter or undertaking not to claim interest is an unfair labour practice.

File an application with the Controlling Authority, and the amount could be collected by the District Collector invoking the Provisions of Revenue recovery Act.
