Nullity of marriage

Dear Sir / madam,

I was married to my husband under Special Marriage Act in September 28th 2011. Before that I was in a live in relationship with him for 4 months and we have known eachother for 2 years. However on October 12th 2011, following a heated conversation, as I was carrying his baby and he forced me for an abortion, I have doctor's records, he leaves the house and never returns even know the fact that I am not well and have not paid any housing and medical expenses. I left my job the same month knowing that I ought to give time to my family hence I resigned. With repeated efforts and appologizing, he doesnot seem to care and adament on parting. This seems to me that he will not come back and already spoken to his lawyer. I want to know if this marriage stands null and void and how do I apply for the same.

Please help me and guide.

you will not get announced null and void, because you done the marriage in special marriage, so both of them having records, then how will avoid, same time you can get mutual understanding divorce its very easy and quickly. or any efficiency evidence.

This is a not case for nullity of marriage but of a divorce.

So apart from applying for divorce if you wish you can get several other reliefs as well like monthly maintenance, provision for your accommodation, monetary expenses etc from your husband.

i agree with experts that marriage is not null and void . if you want a divorce then go by mutual consent . if you want maintenance , right to stay in shared household make application Under DV act

like all i am also of opinion that this marriage is neither a nullity nor void.But asking so suggests you too want to part and he too,then mutual divorce may be the best course to go ahead.
