New occupants membership & pending grievance with developer

Dear Experts, Need to ask you, after redevelopment we forward a ltr to new occupants in salable wing to become members of society. Not a single person showed any interest for same. Now after one year, we existing members decided in AGM on 11-08-2013 that we will close the gate no 2 of society & will not allow the non members parking. There is separate gate to enter new wing. For this sons of developers broke open the lock & gave bad words to woman members of our society. We members went to police station & complaint for same, police booked our NC for same. Just after 3-4 hours his son returned @ 11.07 pm & broke open the second lock we applied to our gate, this time again @ 11.30 pm we went to police station & compliant to police station. They were not ready to book FIR, they said NC & FIR is same. Hence, once again they booked NC & warned the son of developer & freed him. Now, third time, we locked our gate, this time, occupants of new building went to police station and they compliant that we are not allowing them to park their car in society premises. Police is forcing us to resolve the issue in a manner which is benefiting to developer. Secondly, they are forcing that society should make new occupants members of society. In case, we make new occupants members of society, we will not be able to pressure builder. We members need that first developer should resolve our pending issues related to redevelopment agreement, after that we will make occupants member of society. Meantime, new occupants say that they are ready to become member of society & want to submit their documents to us. What shall we do? We have a suggestion that we can ask occupants to send us the documents via developer & after that we can inform developer that we will make them members after our grievances are resolved. We don’t want to make them member till our grievances are resolved.

Sir, In that case, we will weaken our case? becoz no new member is interested in rights of society.

Then continue with your current strategy. I do not see any major fault in it.

Resolve the matter with new members. Take up the issues with builder by sending him legal notice and through legal avenue.
Or adopt the way as suggested by the expert Devajyoti Barman ji.
Choice is yours. first is recommended from my side.
