This is my cousin’s case.
Boy’s Family :- Mother, 1 married brother lived in Dubai (but not in too much contact). 2 sister(1 married & 1 at Mumbai for education),
Boys nature :- Mixed nature, but with lot patience (that’s why he bared her for last 8 months). Never make quarrels with anyone before this. Doing Private mechanical company job
Girls Family :- Mother & father, 1 married sister, 1 unmarried brother.
Girls Nature :- Mouth-fouled, Arrogant. Don’t like to work in home, She is Whimsical, Don’t have control on her mind that when & how to talk/laugh in front of public. Make weird faces while pulling her hair. But unfortunately Boy don’t have evidences about it.
She refused to have sexual relation with boy in last 8 months. It not mean totally not. Boy had sex few (5-6)times but without emotional love in between that.
All relatives knows about her nature. But they hide about her nature from boy.
They made a fraud with us by hiding her real nature. Now they argued that why should we tell this my daughter is arrogant. It s your mistake that you have not inquired …
Girl left my home with her mother & brother before 8 months back
Now competed 1.3 yr to marriage. For separation 8 more months needed to complete 1 year.
Boys have few recorded audio proofs. Only 2 - 3 sentences he can use against her
1. Her fathers and Brothers threatening calls to me and my mother, But in that is also mixed conversations ( how boy is nice & how my mother is bad + Warnings to boy and family+ Law are from Girls side+ Boy will be ruin if they take any action against + Boy spoiled daughter’s life. In this conversation. Boy replied them that we are simple people & will bear as per situation. In all this boy take precaution to keep quite thought they tried to excite him a lot. He was totally aware that they just talk sweet with him now because they wish to enter her daughter in his house.
2. When her relatives come to boys house and agreed that girl is little bit Mouth-fouled (Mu-fat), But you have to re-consider as it’s a small issue. Girl is never do work in home as she was never forced by her father. But she will get habitual.
3. Once girl admitted with boy that At college days she had normal affair. But she was not proceed. (Boy don’t have any evidence for this … not have any big concern anyway)
Boy’s was in tremulous situation since last 8 months. He told me about that sometimes he speak himself ( without any presence). Shouting on others for small-small reason, can hardly sleep near about 4 hours.
Recent the incident happened at Poona that Bus driver killed 10 people near in Poona. In news mentioned that the driver was under some treatment for mental dieses “schizophrenia” with the symptoms. My friend was fainted. As he was self-experiencing the same symptoms since last 8 months. But however his job hampered a lot due to all these situations.
I don’t know whether I can put all situation in front of you. But I tried this for my cousin. I tried to convinced him that everything will good. He is very good in nature. Good understood guy. He know what he is going for is not good but he still wish to divorce her at his age 34. Just to avoid further bad consequences . I’m not wrongly appreciate my cousin. But he is really good than compare to girl.
Good in all these BAD things is there is not Legal case within this 8 months(not from any side). Boys trying for Mutual Divorced but they denied. Because they know now who will accept their weird ‘Mou-fut’ daughter.
On any situation Boys don’t wish this frequent girl in his life.
I need few suggestions:
If they not agreed for Mutual divorce , Can boy have enough evidence or ground to ask divorce. that girls family hide her nature before marriage ?
My most important query is can Boy start for medical treatment for these “schizophrenia” diseases? But his lawyer inform him that if he goes any mental treatment other party can use this as weapon against you ?
As other party is going to file case some 498 section against boys family. What steps he need to take precaution? antisepetary bail will help me? As lawyer suggest him that no need for this bail., as his family is well reputed in society (not well rich). Police will not arrest you. As now a day’s police make inquiry in neighbors, peoples before arrest in family cases. Is it true ?
Can Boy cut the audio in parts and rejoin the bad sentences her parents and relatives talked about him during threatening call ?
As a cousin more than his best friend I wish him to come out safely from this situation asasp.

be brief and to the point . . summarise your case in brief .
not a ground for divorce that she is arroagnt .
if he is suffering from mental illness he should get himself treated .
if your wife files complaint against you police will first investigate then take steps . on case being filed take ABail .

Sir Boy & Girl have not talked with each other since last 9 months.
If girl came back on fileing RCR it will be mess for us and we will loose my 8 months seperation period as well. Boys told now that he will attempt sucide if she come again. Sorry to say in public forum, but he is situation went worst in last 9 months.
Actually girl is not also wish to come back. But her parents forced her for the same.
They as well threatened boys on phone. He recorded as well that.

First I apologized to Mr. Ajit & Mr. Shroff for my lengthy query.
Actually before 2 days, they threaten about 498. After that Boys family come under traumaneous /drastic situation. We told all this proposed Lawyer for A Bail. But he suggest us that not to worry. “Police will not arrest you like criminal. Your company job will not be in trouble”. We though lawyer …..First wish to increase our troubles and then will resolve it for money.
That’s why we are verifying all and put my query in descriptive. Apologized again…
Now he advice us not to take initiate from your side for legal action as not completed 1 year to separation as well. Let them make mind for Mutual Divorce. If not… then we will go for consented divorce.
Today all boys’ family comes to my home. We are expecting your suggestions ….
@ Mr Shonee : How can we go for Annulment ? Both have lived together for 3-4 months. How RCR is wasting. One lawyer told me without RCR you can’t get A bail. Is it true ?

Macyawali the modern day chanakya said go on blaming others than only you can hide your faults .THAT IS WHAT MOST OF PEOPLE DO AND HENCE SUFFER. Since Louzu says in the process you loose your energy and self esteem.
Now you are trapped in turmoil, look inwards. Instead of blaming others look to your escapades . In the process you may come out with minimum damage.
Otherwise system is there to sap all your energy, time and resources.

Hi all Experts sirs,
Now I’m (Boy) talking with you. Sir Speaking himself is like I was practicing how to fight/ argue with other party. And my mother saw this… that it..
Yesterday, I consult with doctor & tell him my entire situation. He just gives me anti depression tablets. & told me this is normal symptoms in such situations.
On filing RCR, Next day her father will dump her on my head. Actually he is also not willing to keep that whimsical girl at his home. He is telling in his relatives that. “Maine shadi kar di hey… Ab me kuch nahi janta”. Irrespective of he hides her whimsical & moth fouled nature from us before marriage.
Is it true that…Husband never get A bail without RCR or any case applied against party?
What are minimum charges for 3 persons to apply for A Bail? ( At Nagpure civil court)

3) The girl parents spent money beyond their capacity for this relations so your greed has escalated. Now you want more and more.
4) From day one attitude of your entire family has changed. Even a maid servant has more facility and respect than me in your house.
5) You want me to work like a machine whole day without respite and rest of time you son uses me like an animal.
6) When I raise my problems of such in human behaviour all of you shout, scold and terrorize me for submission. I am worst than a bonded labour free of cost.

Be firm about charges you have against her affording you a ground of divorce.
Bad mouth(mufat) or what is called outspoken can NOT be a ground of divorce.
schizophrenia or any other mental illness can afford you a ground of divorce subject to prove but it is true that you should not go for her treatment and should file divorce forthwith after completion of legal wait period as this ground may be deemed to have been condoned in cases of inordinate delays.
In answer to "Can Boy cut the audio in parts and rejoin the bad sentences her parents and relatives talked about him during threatening call ?"I HAVE TO SAY THAT YOU CAN NOT DOCTOR THE ORIGINAL EVIDENCE IN DESIRED MANNER.
About bail expenditure you should visit a few lawyers locally to know their charges as place,status of lawyer,clients capacity to pay,and lawyers physic to accommodate with client are several factors that make fees.

This is my candid explanation. My lawyer may be strengthen it as with legal manner.

= In such matter like marriage no one talk about bad about girl even if she is …. .The relatives have fear about her father who is very much arrogant and bad mouth like his girl.

= She was not the last girl on earth for marriage. If they would have honestly told us about her behavior before engagement we would never proceed for further. We all came to know about her & her family’s whimsical nature and attitude after few days of marriage.
3) The girl parents spent money beyond their capacity for these relations so your greed has escalated. Now you want more and more.
= We had not taken a single rupee as dowry. Not even ask from them after marriage. They have to prove it with evidences? Even they took my gold Mangalsutra worth 1.8 lakh when she ran away.
Fact is …. Girls father arrogantly told one of my relatives that he is ready to pay 5-6 lakh rupees to boys parent’s if they are ready to live separate from boys & girl.
This is very ugly mind person who wish to separate my parents from me who grown up me to come to this stage. Now both & my younger sister are fully dependent on me.

= My mother did a lot of work as she was always pretending about her weakness. We never higher any servant. Our family believes on self working nature. Even me since my child hood and my father used to wash our cloths.

= I told you earlier…. we had a sex for very few times within 9 months. She was used to sleep on separate bed many times. THIS IS ONE OF MY GROUND TO ASK FOR DIVORCE.

= This is totally false offence against us. Many of our society members were ready to come to the court to tell the incident where she misbehaves with us.
Well this honest explanation. But one thing I conclude that this is very tough battle for me to fight in future for that I’m ready to face with all consequences. As Indian laws is with Woman. Even if she is wrong.
I will present all my audio evidences and her Sexual co-habit ground in my case
But I have decided to be on stand for battle. To secure me from any BIG case from her of her father, if she come back to my home again.
@Mr Prabhakar Sir :- I was under wrong impression that I was affected by ‘schizophrenia’. But after consulting with doctor I knew I’m not affected by it.

What would court would do if court won’t agree for divorce and still I ‘will not agree to living with her?

Today I received 1 notice from local Shree Mukti Morch run by 'Maharashtra Navnirman sena'.
That we have complain against you form your Wife. Compaint is for domestic violence. Kinldy come to the city based office for discussion on 2 feb 12 @ 1.00 PM. I'm Private company employee. I can't go on office time there. I told them the said me that if you not came you will never need to go to office again. They threaten me like this.
I guess... they would probably bring shree mukti morcha on my home & make noise. And try to enter my wife forcefully in my home.
What action to be taken with this social notice?

we have repeatedly advised you that merely because your wife is arrogant is no ground for divorce . your wife does not want divorce . where is the question of mutual divorce then ?
attned the meeting listen to the complaints made against you by your wife of domestic violence . dont make any commitments .
please get yourself treated by a psychiatrist . you are suffering from mental illness . it may be that you are paranoid . once you are cured you may see your relationship with your wife in new light .
