Hello sir,
its a Money suite civil case,
Actually my opponent has to pay 5 lakhs to me but he didnt do that ,So I filed case and i got Judgement on last year dec'2009 that is my opponent has to pay money within 3 months..

But after 3 months my opponent filed petition that he need some more time, like that he is paying 50k and postponing for every 2 months regularly.

Can i file petition to court that Dont provide any time for him ?

Please give advise how to stop this postponments.

1- There is procedure for execution of the Decree - you can file the Execution petition and take the required steps for recovery of the Decree amount-

2- The defendant is paying part amounts under the Decree and requesting time for balance , there is no wrong as you have not filed any E P - three months Time provided under the Decree - part payment is made and further time is sought by defendant -

3- Generally there will be clause in the decree - (installment Decree ) - in default of payment of the amount by Defendant with in three months - the DHr is at liberty to execute the decree for recovery of amount
4- You can file EP for recovery of Decre amount .

You can file a petition requesting the court to direct him to make lump sum payment.
