My plot not traceble

(Querist) 20 April 2015 This query is : Resolved
Sir,

I have purchased revenue site during 1960 at Bangalore.
The development authority issued notice during 1977 proposing to acquire my plot. Paper notification also issued in this regard. I have been assured to allot an alernate site as per notice.
The development authority not maintained words.
I approached High Curt during 2006 as no alternate site arranged in spite of my repeated request.
Then, the development authority stated, alternate site cannot be arranged as per the rues made during 1980.
Further, they told, plot not acquired for some reason. Hence there does't arise payment of any compensation also.
The case has been dismissed during 2010 causing injustice to me.
Sir, I could not trace my property as the area growned abnormally.
I could not point out any occupied area as mine because of formation of roads and buildings.
The officials are not ready to reveal any actual facts.
It is worth more than sixty lakhs as per the present rate.
In that area MLAs have been alloted sites by the development authority.
Now, I am aged 82 years. I have invested with an anticipation of appreciation for my future use. Hence, I request the experts to guide me or consider the case in order to receive justice.

1. When you purchased the plot in the year 1960 were you not given possession of demarcated piece of land by the vendor??
2. What is the criteria available with the experts to tell you regarding the location of the plot which you have purchased and subsequently stated to have been acquired by Development Authority?
3. What is the opinion and advise of your counsel who is well conversant with the facts of the case including your query? Why do you intend to cross check?
4. You may, if advised by your lawyer, file an application under the provisions of section 6 of the Right to Information Act, 2005 to concerned revenue and development authorities.

You have not stated, what was your response when, "the development authority issued notice during 1977 proposing to acquire my plot. Paper notification also issued in this regard. I have been assured to allot an alernate site as per notice."

You have also not stated about the response of the development authority to your own reaction on authorities notice/ notifications all those 29 years (1977-2006) till you approached the HC.

About your statement, "I could not trace my property as the area growned abnormally," by the way what do you propose to do with your plot at this age of 82 years, even if you are able to trace your plot now at this time after 38 years of start of development.

To be frank these deficiencies tend to indicate more hypothesis than reality in your case.

However, as I don't intend to discourage you or criticise on any issue, if it is your real life problem, please don't mind, 82 years of age is not meant for hankering after any property. If you are very serious about the matter, better assign the matter to some of your kith & kin to pursue the matter to deal with that in whatsoever manner he likes by giving him POA and advice him to consult in person some very experienced expert on the matter by showing all the property related documents and to proceed accordingly. Any reply of any expert on quite a deficient background may not help in any manner in response to your casual query.
