My Grandmother Signed a Blank Paper

Querist : Anonymous (Querist) 23 May 2011 This query is : Resolved
Respected Lawyers,
Sirs & Madams,

My grandmother lives separately in her house in Delhi. She has great properties in her name (house and other properties) both in Delhi and in other states. About a week ago a man visited her in civil dress. He told her that he was a policeman from a police station in Delhi. He told her false stories and, in a fraudulent way, got her signatures on a blank sheet of paper. My grandmother is an illiterate woman and is very old. We're seeing that a fraudulent activity like an attempt to transfer her properties misusing that paper can occur in future. So, we want to take all necessary actions required in this case. Please advise:

1. What can be the possible misuses of the paper?

2. What kind of actions we can take to nullify that blankly signed paper. It was not a stamp paper but a white sheet of paper. We want to take all necessary legal actions and want to nullify that paper immediately. Please Advise.

Thanks and Warm Regards,

First and foremost, report the matter in writing to the Police Station, and get acknowledgement.
It could be that the person can get the writings in the paper to the effect that your grand mother received 'Bayana' of some amount for selling the property for some consideration. Later on, using the said writing, he can try to get specific performance of the contract i.e. execution of the sale Deed in his favour. This is one of the ways of misuse of such a blank signature.

By using blank signed white paper no one can get transfer her properties in their names. As a precautionary measures it is better to publish in the local news paper that non one use that white singed blank paper.

Apprehension expressed by Mr. Ramachandran can be correct. Besides reporting the matter to the police, you may also publish a notice in not only a local newspaper, but also in one or two national newspapers, as the person making arrangement with some person from other cities or states may claim for specific performance on the plea that any notice in any local newspaper was not noticed by him.

Yes.. Am agree with experts.. Just publish a public notice on daily news paper about that unknown persons act with your innocent grandma. If any one having objections mean they will approach you..
