Mutation

(Querist) 19 January 2015 This query is : Resolved 
I have regd deed in my name for a property at Kolkata. Mutation at KMC is pending. Will there be problem if I want to sell it without getting the mutation done. Pls advise.

Though there may not be problem in selling the property but the mutation should be noted. Documents would show the property in the name of old owner till mutation in your favor entered.

The property premises no. is 13 as per Kolkata Municipal Records. But it is No.11 as per the regd deed. So KMC is not doing the mutation. Pls suggest.

If there is a difference in number as per the Municipal records and registered deed, property can be identified by boundaries and if both the properties are one and the same, rectification is to be carried over in the records. Which number is correct? What number did the mother deed (Link document) contain? If the error crept in the regd.deed, you can apply for rectification deed with the concerned sub-registrar and submit the sale deed along with rectification deed to the Municipal authorities for mutation. If the Municipal record is wrong, you can apply for correction of their records with proof of mother deed and sale deed and tax paid receipts. If you sell the property without mutation, the buyer will be problem in problem tomorrow to get the mutation.
