motor accident claim

(Querist) 30 January 2015 This query is : Resolved 
A claim petition of a injured, 70 % disable person filed at place of accident , very far from his residence, by misguiding him. How to withdraw that mact claim petition to file it at another court near to caimant residence.
Transfer petition will b time consuming.
Is order 23 rule 3 cpc application can be considered by tribunal. Any other faster remedy?
