my cousin sister's husband filed divorce petition against her.but she has a daughter also and she want custody of daughter and appropriate compensation from her husband.even in 498 case her husband got anticipatory bail.what should she do now?
Sarvesh Kumar Sharma Advocate (Expert) 05 October 2013
Anticipatory bail is not a final approach in criminal case ; if she proves the cruelty before the court definitly he will punish. However it is very very difficult to got divorce without another concent and don't give your concent without her satisfaction ; however in divorce case file application u/s sec- 24 h.m. Act

SETTLE WITH HUSBAND . petition for divorce filed by husband can be converted into divorce by mutual consent petition . issue of custody of child , maintenance can be incorporatwed in consent terms .

if not possible to settle file application for maintenance in divorce proceedings

Very well advised by the experts, nothing more to add.

In these type ofcases the clear cut solution is to diganose the matrimonial bond. If it works out go for reconcilation otherwise go for mutual divorce. And thereafter bargain for appropriate compensation and start new begning. Most of cases custody of child remains with mother.
