Maternity benefit

The day i told my company about my pregnancy they started harassing me and putting undue work pressure on me
as a result of this mental stress my medical condition deteriorated and my gynecologist advised to me to take 30 days bed rest

When i asked my HR for one month unpaid leave she told me to resign.
I resisted at first but considering that the mental pressure will have ill effect on me and my baby health i decided to resign


Is there a legal action i can take after resigning from the company

Apply for the leave on the strength of the medical certificate. The employer will not be in a position to refuse the leave.

Apply for metarnity leave or leave on Medical grounds. the leave application shall be submitted with Doctor's (not below the rank of a civil surgeon) certificate.

We already tried that but they were not accepting it. So we have to resign from the company.

Do you want to claim that they obtain your resignation under duress or force??
Otherwise there in no point asking for our help after you already resigned!!
Your Service period/ performance/ was job permanent or temporary/ Pvt Ltd Company or Govt/ all counts.

yes i wanted to know what the laws says when the resignation is obtained by declining leave on medical ground even after having medical certificate from the doctor. Am i being penalized for being pregnant and by making me resign the company saved the maternity leave money. The service period was around 9 months. Job was permanent and it was a private company

given facts indicate that you resigned instead of they terminating you. You have given them armour. So prima-facie no action lies against company.
