Lien and technical resignation

Querist : Anonymous (Querist) 24 June 2021 This query is : Resolved
I am a central government officer in department of space, I want to join IIT as assistant professor, can i get lien or i have to resign.
kavksatyanarayana (Expert) 25 June 2021
I opine the IITs are governed by IT Act, 1961, hence the IIT does not come under the central government. So the lien question does not arise.

You have to submit your resignation papers under technical resignation clause with lien clause.
If the rules of the department of space permit you for lien you may avail it

Had you applied for the post under intimation or though the present employer?
Querist : Anonymous (Querist) 04 July 2021
Yes I intimated my current employer, after permission did application.
P. Venu (Expert) 04 July 2021
If so, there need not be any constraints in joining the employment on technical resignation and keeping the lien.

Thanks sir for your response. I'm confused because IITs are centrally funded autonomous Institute. My admin told they have to see rules in case of IITs for lien matter.
P. Venu (Expert) 08 July 2021
The extant norms do not make a different criteria in respect of autonomous institutions. Inthis context you may refer to the the Master Circular of the DoPT dated 27th August, 2018 which could be accessed at https://documents.doptcirculars.nic.in/D2/D02est/Lien%20DraftKdaDv.PDF
