Legal or Not

(Querist) 07 July 2011 This query is : Resolved
Dear Experts,

Need help to confirm whether this is Legal or Not

I am working in a Private Limited firm as a manager, I have started a Pvt Ltd firm myself along with couple of more people and I am one of the director in my firm, I wanted to check on the legal implication whether to continue with the current employer for some more time or but before I continue here can some one let me know the legal implications involved in this regards. If this is not legal then I can take a clear decision for my future...

Regards,
Vivek

If there is conflict of interests in your present job with the business of the new company, viz. if both work in similar field or trade in similar type of products then it becomes illegal to continue in either of any one.

I completely agree with the views of Mr. Vishal.

In addition to reply submitted by Vishal, you should also go through service rules/service agreement executed by you with your employer. If starting business during the service is prohibited or any restriction is imposed or any consequence has been mentioned then only it shall prevail. There is no straight jacket reply to your query.

You are rendering service to ypor employer & simultaneous;ly running your own business. There is apparently no illegality in it.But stipulations in your service contract with employer are more important. If you run a parallel business it is more unethical rather than illegal, even if not a breach of contract. In your case terms of service contract play important riole.

If you want to continue as Manager in one company and Director in another company, it is better to obtain written permission from the Board of Directors of the company where you are a Manager.
