legal heir Certificate

Hi! All,
My parents have a plot in Coimbatore.
It is on name of my father and mother. my father is no more.
now we are interested in selling the same and in this regard they say we need a legal heir ceritificate.
Can you please tell me how to go about making the same.

i m from mumbai in the state of maharashtra the tahasildar grant the legal heir certificate,
so far as the coimbatore is concerned better check with ur local tahsildars office.

Revenue authorities are not issuing legal heir certificates. It is advised hereby that,consult with a local lawyer to file petition before the court for the grant of succession certificate.

The certificate issued by the Revenue authority is survivors certificate, to get the legal heir certificate you will have to file a suit for declaration.

if your father died recently, you can approach your taluk office and apply for legalheir certificate. based upon the legal heir certificate, the property in question can be sold with the aid of your mother. if your father died very long back u have to approach court after approaching taluk office. else your mother can sell the property subject to acceptance and consent in writing by the legal heirs.

Practically there is no difference between legal heirship Certificate and Succession Certificate. Legal Heirship Certificate is duly issued by revenue authorities and it is very easy to get and less time and energy consuming and it shall make the mare go.

Approach the local Tahsildar office with the death certificate of your father. After verification, legal heir certificate will be issued showing that you and your mother are legal heir to your deceased father. Fees are nominal and less time consuming.

Courts neither issue legal heir certificate nor has the power to do so. If there is any dispute with regard to legal heirship, approach the Court and it can only declare legal heir status. Even then you have to approach the Revenue authorities (Tahsildar) to get the certificate on the basis of order of Court.
