Lease

(Querist) 08 September 2012 This query is : Resolved 
My land lord Trust has given me notice for terminating the Lease Agreement. I am staying and conducting business since last 30 years in the said premises. I have no other place in Mumbai to shift my business. I earned good will of my business. The lessors have tkaen this land from BMC on lease for 60 years. How can I protect my interest. Is there any remedy for protecing my interest and and extend my Lease. Thank in advance.

Your matter can not be dealt with a remote control.You need to visit personally chamber of a lawyer dealing in rent laws of your state,show him lease deed and take opinion.

Under Maharashtra Rent Control Act vied section 3 sub section 2 ,the state Govt.has power to exempt the application of the Act over such premises of whose land lords are Public trust for charitable or religious purposes but simultaneously according to its' proviso that can not be done by adversely affecting the tenancy right of existing tenant.

A tenancy protected under this Act shall not expire by e flux of time so long the tenant agrees and continue to pay the amount of the, standard rent and permitted increases, if any, and observes and performs the other, conditions of the tenancy, in so far as they are consistent with the provisions of this Act.(see S.15)
