We had ancestral land in hingoli district.one person is cultivating land since last 40 years.we did not had contact with them due to father's job.the land sat bara is on my father's name and sadhe kul by other party. 8a shows my father's name.can we claim the land ?is there any benefit of putting case now ??

The land is in the name of your father, he is owner of it.

Discuss in detail with local lawyer, show him all documents and proceed as per his advice.

Obtain a copy of 7/12 copy from the Tahsildar of Hingoli and with that proof consult the person who is cultivating your land and request him to handover your land. Otherwise, contact local lawyer and file case in the court of law

Yes. You can definitely take back your land. Need to engage a local lawyer, then to issue and notice seeking vacation failing which to go to revenue court.

Yes, your father can claim the possession.
Find out amicable solution in person-in-possession, if do not agree engage a local lawyer to file a suit for possession and mesne profits.

The facts posted suggest that the tenant-cultivator is protected by the provisions of Maharashtra Tenancy and Agricultural Lands Act, 1948. Certain protection has been provided to the cultivator in Maharashtra, still your father is owner of the land, complete ownership can not pass to cultivator without his consent.

As advised, discuss in detail with local lawyer after showing all related documents.
