joint holder of a property

Querist : Anonymous (Querist) 22 December 2010 This query is : Resolved 
we have a shop at thane which was in a joint name of my parents 1st name is of my mother & 2nd name is of my father but he has died without making a will or a nomination of the property can my mother as the 1st holder of the property have a right to sell the above mention property?

Your father's other legal heirs also have share besides your mother, in your father's share.

The share of your mother has increased but you as well as your all brothers & sisters and your grand mother have also to sign the sale deed as all you are also co-sharers now.
