IPC 279 and IPC 338

My car was not moving, infact engine was also off.I stopped the car for a moment to visit bank ATM.While I opened my car door, a rikshaw banged on the door. My car was stationary but rikshw hit me from back side. A lady on rikhaw fell down and got head injury. In few seconds people took her to hospital in a different car.I was left alone on road. I left the place in 15 mins. Went to nearest hospital (Ayushman hospital) in another half an hour. Hospital reported no one came for any accidental help. I came back to home.In a days time i recieved a call from police station that a FIR is lodged against my name and have to go to court for case...Please help me ASAP...they have signed me for IPC 279 and IPC 338...AM stressed..What to do????

Go and consult an Advocate who will give you legal advice about the procedure and probable course of action for effectively defending/contesting the case.

You should make a representation to higher police officials of your area and should apprise them all the factual situation and should pray to cancel false FIR lodged against you failing any favourable action, you shall have no other option but to face trial in the court. For this purpose, you shall have to appear before concerned police station and simultaneously should have to arrange for bail through court. This is simple case though there is some harassment in facing such trial.

Both the offences are compoundable.No need of stress.Consult a lawyer.

Yes you would have to attend in the oncerned or juridication police station and simultaneously will have to obtain for bail through court.

Make sure trail has to be faced.
