Injunction.

(Querist) 04 December 2012 This query is : Resolved 
I am a NRI. My father has left many of his properties in Chandigarh and in some cities of Punjab, India. These are all the properties which he made with his hard earned money. The properties include two houses and also lands in some vilalges. After marriage I moved to UK with my husband. Now I have learnt from a few of my relatives that my uncle (my father's real brother) and his son are trying to illegally sell these properties and usurp the amount. Please tell me what should I do to stop these people. Also suggest me a lawyer to handle my case as I do not know any lawyer there.

Would highly appreciate any help.

you can contact Mr Asish Devasar of LCI for your case . he is practising in punjab and haryana High court .

did your father leave any will . if he left a will apply for probate . if he died intestate then apply for succession certificate . also move court for an injunction restraining your uncle from selling those properties

You should file for mandatory permanent injunction to stop these persons from usurping the property belonging to your late father.

You can contact even to me as I also do practice in Bhiwani as well as in adjoining areas of Punjab & Haryana. You need not to file case at Punjab & Haryana High court directly as the cases shall have to be filed in lower court and prior to that the status of the properties is required to be known fully with the relevant revenue record.

You do need to file a law suit of injunction in any of the jurisdictions in which properties situate at district level civil judge court.
