(Querist) 22 May 2013 This query is : Resolved
In Divorce Case of Cruelty. 1. Can I produce my Wife's comunication over cell phone to me as a proof. Also the text messages she sent to me. Is it a valid proof in Court? Or I need to verify from any organisation? Which organisation validates those which can be produced as evidence. 2. Is a written document of a witness person can be produced in court as an evidence, those who can say about our relationships and conflicts. What is the proper way of presenting those?

The evidence by way of video recording or writing is duly admissible in support to the SMS & mails.

Actually My Question was Different. I filed Divorce case in Kolkata from my home town. Before filing I was in Mumbai, And We had a tough time, as a statement of my relationship my land lady can give proof. If I record her statement in Video format. Can i produce in kolkata court. One main thing She cannot come to kolkata being a family person. So can i give her statement where she is physically not present in kolkata

No. You cannot get her recorded statement produce before the court. Her personal presence is must.

Had you clearly mentioned this fact in your query, valuable time of you and experts would not have been mentioned. How can one anticipate what is running in your mind without your disclosure?

e mails and SMS could be product out of some anger, so it is to be contested.

Marriage is it permissible by emails and SMS?

Obviously divorces cannot be mooted by these fancy ideas.
