should I file in high court.

If an I.A.(Interlocutory Application) was dismissed by a Subordinate Judge or a Munsiff court, an appeal is to be filed before the District Court only by way of Civil Miscellaneous Appeal. If an I.A. was dismissed by a court of District Judge, an appeal is to be filed only before High Court.
