Dear Sir, My uncle is 75years old and living in Nagpur with his elder son.He has two sons and a daughter all married.The flat in which he is living with his elder son is his own property puechased by him in 1970.Now he want to transfer this property to his younger son with all rights.So what will be the procedure?can his elder son[who is living with my uncle] or daughter take any objection?please help.

if your uncle self earned property he will give any one with out other concern, if ancestral property all legal heirs having rights.

ask your uncle to execute a gift deed in your favour . have it duly stamped and registered . if it is eexecuted out of free will brother and sister cnanot object

As property you tell is created by him,and are not ancestral,he is free to give it to any body,and if he executes a gift the donee shall become absolute owner after its acceptance.Will would be less expensive but may open the door of litigation post his death.

the property in question is self acquired of your uncle so he can gift/will/sale and transfer it as his own wish,no one has right to object.
