Foriegn travel with pending trials

(Querist) 20 June 2013 This query is : Resolved
Dear Experts,

I am standing in trial on a IPC 420, 417 case which of course is falsely framed on me. The complainant has not turned up and i have attended 7 trials so far. My next trial date is 2 months away. I am currently wanted to go abroad for a month on official purpose and will be returning well before the trail date. Will i have to get court's permission for applying visa. is there any other complication involved in this.

Thanks in advance.

You have to get permission of the court.
There are many decisions in support of granting permission by trial court
Rajendra K Goyal (Expert) 20 June 2013
It is better to get permission of the court.
otherwise if your passport is not deposited, no restricting condition imposed by the court in this respect, you are able to return till next hearing, you may proceed.

Thanks for the advice.. My passport is with me and no condition is imposed both in bail or chargesheet..

Wil it reflect anywhere in the system of immigiration of the country i am entering?

i know this is not a big case, but to be sure.. Please advice

what is the case which you believe is not big
Raj Kumar Makkad (Expert) 23 June 2013
There is no such term like big or small if facts are not disclosed by you.
Rajendra K Goyal (Expert) 23 June 2013
Agree, if the facts are not available, how can be said that the case is not big ?
Sanju Krishnan (Querist) 26 June 2013
Thank you all for the reply. According to me I have not committed any crime. I used the word big just to emphasize my belief that the allegation on me is not huge. If the crime is big atleast the complainant will attend the trials and witness will come. But here, police are in search of the complainant and witnesses.

Pardon me if am wrong.
