(Querist) 22 October 2014 This query is : Resolved 
Respected Seniors!

on the appearance of Accused in 138 NI Act, The Magistrate ordered to furnish 5000/- one surety and after taking that FDR from Adv. Mutually aided Society, on the next date of hearing the same was lost and the person who stood as surety is having the xerox for the same. now what can i do to get the original?
please advice. urgent.

Once surety is granted; matter will proceed; no one will ask for it; unless accused remain absent w/o exemption.

who lost FDR? whether it was filed in court ? apply for duplicate copy from bank as original has been lost

The magistrate is he wants can make waiver of the same.

FDR is non transferable instrument, duplicate would be issued by the Bank on submission of indemnity bond and request.

The duplicate FDR can be obtained from the bank against the lost original receipt, approach the bankers for the same.
