Extension of window frame in mhada flat

Querist : Anonymous (Querist) 10 January 2012 This query is : Resolved
Dear Sir,

Please help me as one of my friends owe 2 BHK flat in Mhada colony and he had done rennovation work in his flat before the formation of Society and had extended the Window Frame wall ahead to get storage space below the window (like flower Bed). This was done before the society formation. Now he is residing in his flat and just in the Socity AGM, he was informed to break the wall and restore it back, but breaking the walls and will again cause problems. Request you to kindly advice me how to go forward. Most of the Mhada Residents have extended walls in most of MHADA Colonies.

he must obey order of agm Resolution of AGM, with Majority.
or challenge it in co-operative court, where he can prove existing practice of extension, where no one suffer, and is for gardening, plantation purpose. Get photos of other extensions in support, and insist that all be treated equally.

was any resolution passed in AGM?

generally in Mumbai it is common practice to extend the window frame to get additional space .

if no resolution has been passed in AGM and merely requested to setore it you can decline to do so .

if resolution passed then it is binding upon you . on your failure to rstore it society may move coopeartive court against you

Thanks for your reply Mr Ajay Sethi.

But this was done before the formation of the society. Than why is society putting an objection on the same?

was resolution passed ?
after formation of society managing committee is elected to govern the affairs of society . if no other member has done it the other members dont want you to ruin the facade of the building .
