three times 498a

Five years ago 498a booked in a PS not tried in court, next subsequent year again booked not tried, Two years later DV & compromised,This year 498a.
Meanwhile OP was put up against her before DV !!!!

Both husband,wife staying seperate around 3 months
But Wife would either bluff or refuse to accept the OP notice.

Is this sufficient to get OP (Divorce) or whats the best solution?

Lets do once again
Thrice wife booked 498a yet to be tried in court!
& a DV case stayed in HC.

In between Husband opted for divorce
She is not willing to take up even divorce notice?
Lawyers/police continually saying this family is not good to stay?
Does any one thing this is good thing to continue or live seperately peacefully

If we think divorce is solution, how do to obtain?

498A has time limitation of 3 years so you can challenge if before HC if it has been invoked again after 3 years.

Secondly, there is no stright formula to get divorce. If she is not receiving notice, it will be published and even then if she doesn't appear, it will be taken ex-parte.
