Subletting of office

my client rented an office space few years back at less than Rs 3500/-. now he required the space as he has lost all his business and only single property is left which is residential and has shop in it (the abovementioned rented office). when nothing left with him, he asked tenant to vacant the property, the tenant refused and further sublet out the rented property. My client cldnt do anything and he does not have any proof so please suggest in such a situation what step should be taken. he wont get justice anywhere??? i really want to help him.

Lawyers are the treatment of all problems. Your cleint has every right to get vacated his premises from his tenant. Even if he has no proof of tenancy even then he should serve a notice to him vacate the premises within 15 days as the landlord is in need of premises for his own use and secondly the tenant has got it subletted and third that he has not paid him the rent pertaining to 36 months.

Tenant shall either get vacated the premises or your cleint shall have to file Eviction petition before Rent Controller.

Subletting the premises is a good ground for eviction and your client also additional ground of bonafide requirement of using the premises, so you can file eviction petition before the rent controller.

As rightly advised by Mr. Makkad you first issue a legal notice.
