Eviction of house owned by me as senior citizen.

I am a senior citizen. I have bought house where I was born &grew. This house was on we by my uncle. I had allowed my mother to stay in this house in a town. On humaterian ground my sister's children were allowed to stay in that house. My mother has expired. My sister's children are not only refusing to vacate, they have attempted to murder me twice. The FIR &cases are in court. They have filed a civil suit claiming that my mother has gifted this house to them . Non of my parents were owner of this house,any time.
Can I go to DC, Get my house evicted with court verdict, under ruling do Delhi court on 28 Feb 2017. ,For eviction of house of senior citizen.

If you have purchased the house, you should be having the registered sale deed in ur favor. Hence it should not be a problem to establish your ownership of the house in the court. So far as ur query whether u can file an application before the DC under the Senior Citizens Protection Act, you may do so. However the DC may not proceed with the case as the ownership/title of the property is in dispute and is subject matter of litigation in the civil court. Better course appears to be that you may file a cross suit in the same court for eviction of your nephews from the property. However you may discuss with your advocate and take a final decision in the matter.
