Lady wants divorce

Dear experts,
I want to marry a girl. She has been staying away from her husband for around 4 years. Her husband left her because she couldn't pay dowry as per his demand. Now she is living with her parents in MP. Can she files case of divorce from her town? She doesn't need maintenance, she just want to divorce. Please advice.

She can file case of divorce from his home town.

She can also file other cases from her home town.

" I want to marry a girl " is Not the Right Sentence.Still she is Other Man's Wife .Unless there is Divorce you can not Think or Imagine all this.Your such statements any where could easily Lead/Land you in Adultery.

MCD can be easiest and fast recourse if both husband and wife agree to it.

Until divorced she is wife of someone.

Court alone can grant divorce.

Get the marriage dissolved through MCD or contested divorce from your wife. And then remarry the girl of your choice.
