bigamy accused asking for maintainance from childre

my father has married another lady in court without disolving 2nd marrage, ther are cases of bigamy and domestic voilance going on him, he has filed a case against us(children) for maintainance what should we do is ther such a case in history of indian law

If he has sufficient means to maintain him self, he can not claim maintenance. Plead before court that if he is ready to maintain his second wife, why not to him self. Use the domestic incident report provided by protection officer in DV Act, if it is in your mother's favour, and other evidences also.

Children are required to maintain father and mother if they have no source of income and have to fall back on children. But your case needs to be studied in detail before offering a proper advise as the details are not sufficient.

The family court and session court has granted maintainance of 1500 and 2000 respectively and in his reply to court he has said we are not his children and mom has taken care of him, if the law allows maintainance in this case will it not encourage people to disown their wife and ask for maintainance from children to enjoy life with his new wife is that crippleness of law and it indirectly approves bigamy
