Pension Dispute of Disability Pension in Indian Army Jurisdiction thereof

(Querist) 25 June 2008 This query is : Resolved 
Joined Army in 1972 Declared 30% Disability in 1979.Notice and Representtion failed.Civil Suit decreed.Execution pending.Objection regarding jurisdiction.Whether Civil Court or the High Court or Supreme Court has initial jurisdiction to try the suit.

There cannot be any objection after the suit is decreed. It is done with malafide motive by the opposite lawyer.

Your claim is against Government of India, they cannot say that, one of the courts in a particular place does not have jurisdiction. If they had such objection it has to be raised at the earliest point.

In matters connected with Army, you get territorial jursidiction. Every court of law in any part of India will have jurisdicion to try them except for Martial issues or disciplinary issues.
