Legal Questionnaire.

Query No.1 : Payment of money is generally guided by payee's choice of mode of payment. That is the choice of the person who will use the money after payment. Is there any scope for payment policy by Govt. or other financial organisations? What is the legal perspective in this regard?

Query No.2: Reserve Bank of India did not make any mode of payment as compulsory. They are in favour of popularizing electronic mode of payment only. But financial institutions are making payment through NEFT/RTGS/ECS compulsory. Can an individual approach Court of Law for seeking relief in favour of his choice of mode of payment?

Query No.3: One of my neighbours is willing to receive his salary payment through cheque from his office. But his office is denying. Can he take legal remedy to compel his employer to accede to his demand for receiving salary through cheque?

Query No.4: Can an individual or an Organisation rightfully and legally demand another person's bank account particulars to be formally disclosed by him for paying salary and/or LPG subsidy?

Query No.5: Under Article 21 right to life and personal liberty is guaranteed. Whether an individual is legally bound to disclose his bank account particulars to others(LPG Distributor) and/or to his Employer?

The queries numbering 1 to 5 put forward on 20-2-2015 relate to me also. It is my personal problem as well as the problem of the general mass. I am not getting monthly salary from my employer since more than two years. And I wiil not get LPG subsidy from 1st April, 2015 onwards because I have not submitted my Bank A/c particulars.
Legal views of expers are solicited.

How you link your problem relating to non-receipt of salary from the employer and lpg subsidy with any of your general queries. None of your five queries relate to your personal problem of non-receipt of your salary?

Moreover, if you are not receiving salary for more than two years, a pertinent question arises, with what specific interest you are still serving your present employer without salary and how you are surviving without receipt of any salary for the last two years?

All the 5 queries posted on 20-2-15 relate to justification of demanding/exacting Bank A/c particulars from the citizens of India. I, being a citizen of India, am therefore related to the five general queries posted on 20-2-2015. I have not submitted my Bank A/c particulars to my employer and have therefore not been paid salary by my employer for more than two years. I have not yet submited my bank A/c partculars to my LPG distributor and therefore will not be eligible for LPG subsidy from April, 2015. Therefore the five questions relate to real life problems and personal also not merely academical and general.

I am now 50 years of age; and at this age who will give me another emplyment? This is one of the reasons why I am sticking to my present employer. Moreover I love it, having served it for more than 20 years. For the last two years I am leading a wretched life parsimoniously expending whatever I saved during my 20+ years of service and getting donations from relatives and well-wishers. Your valued suggestions may help me to come out of the problems I am facing now. The problem is rooted in the whimsical demanding of Bank A/c particulars by the employer and/or the Govt. Please reply.

Yours is an unreasonable query with no facts to be seen in the light, the details what you have stated appear to be for the sake of updating your academic knowledge by availing free service of the experts here. You have overlooked my real problem submitted on 21-2-15 through Android App. viz. Lawyersclubindia, yet you are claiming youself as legal experts and of reasonable mind. God knows! May be you are experts but not for me. This reminds me a hindi doha "bara hua to kya hua; jaise per khajur: panthi ko chaya nahi, phal lage ati door". Today I am uninstalling the above App. and also unsubscribing from your news-letter. Many thanks for your invaluable observations and suggestions.

Until you convince me, you won't deserve chhaya (solution) from any one of the members here. You should not have expected solutions to your queries, which every one has rated as vague academic queries and without facts. You are not favouring any one of the members in any way, if you are uninstalling any app or unsbsribing any newsletter. Your needs can be fulfilled only when the members feel your problem to be genuine, otherwise nobody is obliged to start tutorial classes for persons like you.
