Increase in notice period

(Querist) 26 March 2014 This query is : Resolved
Dear Experts, We want to increase the notice period for the termination of the employment of our employees who are joining us from April 1, but we do not want to increase it for the employees who have joined us before April 1. Is it legally correct?

Can you please let me know the name of the act from which I can take reference.

The matter of Notice is based on equity and is generally governed by the contract of employment. There is no specific act which governs Notice period for termination but the Industrial Dispute Act,1947 deals with the retrenchment and lay off etc and certain procedures to be followed by employers covered under the Act.The Industrial Employment (Standing Order) Act,1946 , if applicable provides for registration of Standing Orders for certain establishment which shall be binding and termination of employment is one matter among others which may be indicated.

However there is no legal imposition as to what should be the Notice period
