Dear Sir, In Short, I took loan in 2012 @ 22.25%(First loan), after 12 month, I got the call for Top-up @ 17-18 Commitment by Executive(No Evidence-2nd Loan).I was trying fill-up the form, but executive stop me for filling the form or agreement. I did signature and handover the bank agreement to Executive with anything filling(blank). they disbursed the Loan. When first EMI persent in my bank, I asked about the details of EMI. I got that they disbursed the loan @ 22.25%. I am fighting with bank last 9 months. But all wasted, because i did signed the agreement. I was reading the agreement or form. I found,
1. I fill-up the rate of intt. in application form by me, can be possible court consider my application rate of intt. against my agreement, when i file the case.
2. I didn't get the bank document within 15 days, or after debited my first EMI-within 15 days I called them. but they did not ready for cancel the loan.

3. Condition of Bank : - Preclosing Charges rate @4%, but It can possible after one year.
I request to bank, I was ready to pay foreclosing charges, But bank said as per your agreement, you can closed.


Kindly provide your valuable, advice. I don't have a lot of evidence, except, communication through email, or Registered post or I sent a legal notice also to bank.

you have signed the form . once you have signed form it is binding upon you . read term and conditions mentioned for grant of loan . if as per agreement foreclosure charges are 4%you would be bound to pay the same .
insist on foreclosing loan after expiry of one year .

This is normal practice in private Banks specifically where marketing agent is involved. Their main concern is to earn by misguiding the client.

Go on sending e-mail to higher authorities for permitting you fore closer as the loan was given to you through wrong information. Otherwise wait for one year.

Without seeing the terms of agreement it is difficult to advise.

Dear client...
If possible I would like to see all the correspondence you had with bank ... then you can take further legal proceedings...
as per the present scenario...
