Sir, (IA)
There are 3 respondents and an appellant.Appellant files IA for submission of certain documents. Resp. No. 1, is Municipality. R2 is complainant, asking R1 the Municipality for demolition of unauthorized construction by Appellant.Appellant raises objection to the qualification of Executive Engineer.In support of this contention Appellant files certain documents which are not of much relevance.In absence of his counsel the R2 by oversight/unknowingly on asking by the Judge, submits, "It is Municipality who has to submit supporting documents and prove.(R1's Counsel was present). Therefore my Counsel who was to come was saying that, he has no objection for the same." The Judge notes it down mostly on order /office sheet as "no objection by R2". R2 waits re-submits that, the same remark and noting may please be reconsidered as he does not know, whether it will affect the case adversely.
Please inform as to what is the effect of the above noting/submission and suggested way out of it. The matter is posted for tomorrow.

If R-2 has no objection then how you are concerned with his consent. Nothing can be opined qua the effect without going through the details of the case. ask this question from your lawyer who is having the case file.

R-2 may have consented in haste and the documents have been taken record. However, the relevance as well as the evidentiary value of the document could still be disputed.

Consult local lawyer and show him all the documents.

If a consent has already been given before the court, it cannot be taken back.
