Challenge mlc (medical report)

(Querist) 23 July 2013 This query is : Resolved
In our case MLC has not been legally proven by the doctor. No cross questioning has been done either on MLC or on medical report (X-Ray).
We want a decision of High Court or Supreme Court wherein in absence of legally proven MLC, the accused has been acquitted.
Statement of victim, MLC, X-ray and treatment done are all mismatching with each other. I mean these are all contradictory to what really happened to victim.

Its IPC u/s 325 wherein the accused has been convicted, we are further facing CA now. Because of lack of our earlier lawyer this situation has arise.
We are in need of such judgements of SC /HC wherein medical report has been challenged and benefit has been transferred to accused. The main lacuna in this case is that nowhere in prosecution the Medical report was proved and also no one from Hospital tuned up for evidence of the medical & X ray report.
Another twist is, in the statement victim is saying injury on hand whereas in X-ray report & MLC the findings are minor injury on fingers.
