Tenant v/s landlord

(Querist) 19 July 2013 This query is : Resolved
Does any tenant file a case for compensation on account of not providing the rent receipt to the tenant by the land lord. if compensation can be claim then upto what extent?
Rent agreement can be void if by mistake in agreement use of property is shown for commercial purpose instead of Residential purpose however the property is for residential purpose only.
Tenant can claim compensation from landlord on account of not fulfilling his commitment, as land lord promise to get the rented property white wash and marble floor detrition
If Tenant is not vacating the place then what course of action should be taken by the land lord?

I have not provided the rent receipt to my tenant even not pay the taxes on this income, a part from that I did not fulfill my commitment for marble floor detrition, now there is a way to get rid of them or do I have to pay him compensation of INR 250000, for what he is asking. Even in Rent agreement by mistake we have mentioned the use of rented property is commercial instead of residential,

in other words he is not a licensee but a tenant as per your rental agreement . lanlord is bound to comply with the terms of agreement . if he has failed to white wash the house/ fit marble flooring tenant can seek compensation from him

settle the issue amicably with your tenant .
Pratik Jain (Querist) 19 July 2013
Actually for white wash and floor deterition is not mentioned in the agreement it was a verbal commitment and rent receipt is also not mentioned in the agreement. is there any way to get out of it without compensationor do I pay. What else can be done to vacate my home.I have not shown rental income in my return what action can be taken against me
ajay sethi (Expert) 19 July 2013
if there is no such clause in agreement you are not bound to paint the house . however always honour your commitments verbal or written .

terminate your agreement as per termination clause in agreement .

Issue a legal notice to the tenant. Ask him to vacate the premises within the notice period. Clearly mention that there is not such clause relating to white wash or flooring. Call some of your relatives from your village or place and later file eviction petition in the court on the ground that you need the premises for yourself.

If he complaint to the income tax office regarding tax evasion , as i have not shown my income which i received as a rent then what happen ?

and he have recorded our conversation in his cell phone regarding flooring and white wash.

I am staying in govt qtr however i have my own home in delhi what happen in this case.
Dr. Jyothi Vishwanath (Expert) 20 July 2013
If he complains to the income tax office, you pay the tax. Complaining to the income tax office will not benefit the tenant in the compensation he is claiming against you.
Where is the disputed house situated?? Where is the quarter situated situated?? Where is this other home situated?? Clarify all
