(Querist) 21 October 2012 This query is : Resolved
dear sir,

my uncle, 84 years old and suffering from a paralytic stroke, has his house in the village vandalised and locks broken by how own elder brothers son after he refused to hand him the keys.

within 10 days of the tresspass an fir was lodged by uncle and pursued through speedpost letters to sp, dg, dm and cm uttarakjhand where the property is.

uncle lives in calcutta now but did go to the uttarakhand property for six months each year from 1989.

he is in possesion of the u khand property from 1989.

over two months have elapsed. fir not registered.

the sho has asked him for his statement in writing which was done 15 days back.

i seek from knowledgeabble forum members to seek right information through rti for non registering the fir.

i am new to such cases and hence this request.

you need not to have recourse to RTI Act.

better file a criminal complaint before the Magistrate's court and proceed with the case.

visit some local lawyer and file the case at the earliest.

RTI is not going to help you towards your desired purpose.

I do not think that the reson for non registration of FIR would be of any help to you.
Go to the court of the Magistrate and file a petition u/s 156(3) crpc for direction on the Police for causing necessary information.
You need the remedy not the reason for delay.

To out more pressure your uncle can file case from Calcutta as well.
If you mention his residence then I could suggest the right court for fling the case.
The counter cases from far away places like Kolkata did yield good result to my clients.
