Our property purchased by father's brother in 1962.

1.The partition deed registered

2.The partition deed clearly mentioned the property purchased from family fund.

3. They are aged & sons wants to divide the property

4. My father & uncle alive

5.Both are support to my elder brother.

6. I am living in the property by birth

7. I challenge the property purchased by the family fund (i.e. agricultural land owned my grand father & his savings )

8. They file the suit to vacate the possession

9.They challenge the property is self acquired by paternal uncle.

10. He (paternal uncle) partition the property to his brother (my father) love & affection.

11.If possible to given partition the self acquired property

12. Pls provide any article & section is favour of my side

IT CAN BE DONE ONLY MUTUALLY OR BY A SUIT WHERE FREE CONSENT TO EARLIER DEED IS CHALLENGED.WAS PARTITION DEED REGISTERED?

Thanks for valuable reply. Kindly note the below points

1. The partition deed registered

2. My father & uncle alive
