One of my friend has took the reliance post paid sim which credit limit was 1200 rs. he became the defaulter with the bill as he says that the company has never sent him the hard copy of the bill nor he asked the company. and now company had sent him a legal notice through pre-litigation for settlement as the amount of bill is now rs.2371. so can he avoid to pay the bill at this stage. or if he is ready to paay can he allege to pay only up to his credit limit that is of 1200 or can he escape his liability just by paying a mere sum..of 200 rs.

Let them produce the split bill for their claim. The claim must be as per law.
Your friend has every right to claim the split bill as they are liable to show the proof for their claim

Liability to pay bill up to the usage charges of service cannot be avoided. In default case, there seems no logic in paying Rs.200 or up to the prescribed credit limit by your friend. Credit limit is fixed by the company within which that does not prefer to discontinue in providing service to the subscriber by way disconnection of phone on account of non-payment of bills.

Better advise your friend to obtain a duplicate copy of the bill from the nearest service centre of the company and clear the dues to avoid any likely harassment through litigation by the company.

Let him pay the bill amounts for the monthly usage charges plus interest if any and settle the matter with the mobile company or through the pre-litigtion settlement. It is not fair on the part of gentlemen to cheat the mobile company, or any others for that matter.
