Gratuity payable

(Querist) 06 July 2012 This query is : Resolved 
Dear Experts,

One of our employees has given his resignation paper today and he is going to serve his one month notice.
His last date of working would be 25th August.
He is completing is fifth year next month.

I want to know will he be eligible for Gratutiy since he put of his papers and just serving notice period.

Treat this as urgent and Kindly Clarify.

Yes, he is eligible for gratuity subject to completion of 240 days at 5th year.

His service up to 25th of August would count. Date of notice has no concern with eligibility of gratuity.
