Hi,
In one of our anticipatory bail applications filed for the offence of Section 307 of IPC an interim protection has been granted.
In the police report they have asked for the custody of the applicants as they havent found the clothes and the weapon in question.
My query is that :
How can we defend our applicants in such a scenario ????
Is there any judgement available that an anticipatory bail can be granted to the applicants charged with the offence of Section 307 ?????
Please advice...
The matter is kept tomorrow for argument.

opinion can not be given on limited facts given in the question, however Anticipatory bails are regularly granted in cases u/s 307 IPC and there is no need of any judgement. Argue your case on merits and hopefully you will suceed.

307 is no bar of seeking AB.
The bar is that the investigations are not completed and the IO is asking for custodial interrogation for the search of clothes and weapons.
In such scenario, only strong alibi can help you.
