I paid sale consideration by way of Banker’s Cheque towards my share to the vendors, wherein the details of the said Banker’s Cheque is mentioned in the aggrement of sale cum GPA (ie AGPA) deed.


At the time of registration, when I was out of station, my brother got registered the sale deed in his name only, for the entire property. Since he assured to register a sale deed on my name for my share,


Now he refused to do registration on my name.

So what I have to do against him for the recovery of my share of land.

Only remedy is to file civil suit for the cancellation of sale deed.

Is previsouely agreement to sell registered before sale deed by you and your brother??

if answer is yes.

so, you can file civil suit for part cancellation of sale deed.

Dear Querist
first of all find the terms and condition of the Sale Deed, how can a person execute a sale deed with other person other then a person who is the party in agreement to sale.
you can file a case under specific perfomance against property owner who sale the property.
