Rent free stay for services of non-owner

Querist : Anonymous (Querist) 29 December 2011 This query is : Resolved
Respected Experts,

Here is the situation..

Mr.X owns a house. Mr.Y has no power of attorney for this house. Can Mr.Y instigate Mr.Z to stay at Mr.X's house rent free? The property owner(Mr.X) does not benefit however, Mr.Y utilizes the trade services of Mr.Z (free in exchange for rent) for Mr.Y's home and business.

Can a civil and/or criminal case be filed for this against both Mr.Y and Mr.Z?

Your opinion please.

Thanks.

Yes you have both civil & criminal remedies in law.

Consult a lawyer and let 'X' file a suit of eviction or ejectment pleading 'Z' to be tenant orally month to month @ some rate of monthly rent or pleading him temporary licensee depending on time of occupation as early as possible, else the way you are drafting query here it may become too late.

has Mr.X given the house to Mr.Y on rent?
What is the relation of Mr.Y to Mr.X?
Is there any agreement between X&Y?
Query is vague. Please clarify with details.

Relief lies against Z and not against Y unless it could be shown that Y is getiing the fruits.
In any case before it is too late file a suit of eviction of licensee against the Z.
Property needs to be cleared first than punishing Y.

What is the relation between x,y and z? provide detail to get reply.

The issue is not at all clear.
On what position Mr.Y is enjoying the possession of premises? is he related to Mr.X? Is there any agreement between Mr.X and Mr.Y with regards to the premises?
lots of such thing need to be cleared for an appropriate solution.
Mr.X can definitely file suit for eviction of Mr.Z as advised by Mr. Barman
