Dear sir, My nephew has married during November 2004 and he has a kid out of marriage and the kid is 4year old. lady is a school teacher in a private school ,in Bangalore. The couple are not getting on well and the boy insists for separation since the wife is not cooperating with him and also with his mother. what is legal course my nephew can take to get separation from her. What is the status of the kid ,in the event of separation. Can the kid is eligable for the property self acquired by her mother and also inherited property by his mother.

yes if you feel to re patch your small small query and issue then you can file a petition for separation.
The child should be live with her mother only up to 12 yrs.
So think twice then do the things, All matter can be settle with mutual talk, and through away your both egos. and keep the mind to service aged people and one day we too touch the age.

I disagree with the provided opinion.
The child would stay with the parent who can look after the welfare of the child best. Of course it would be decided after a lot of wrangling in the court.
Why don't the couple sit together and try to sort out the things amongst themselves, family members can also help in resolving any issues. Otherwise the Mutual Consented Divorce option should be explored.
Otherwise he is looking forward to long court battles.
